Can I get Amazon Brand Registered with Common Law Trademark Rights (Use-Based Rights)?
Hi All,
I hope someone might be able to shed some light on the issue I'm having with getting my brand registered via the Amazon brand registry. As you probably know, Amazon requires a registered trademark number... However, I have been operating my business and brand in the public domain for over 20 years, not having paid for a registered trademark number, but operating under Common Law Trademark Rights (Use-Based Rights).
Per US law, in the US you automatically acquire **common law trademark rights** to a brand or logo simply by **using it in commerce**. This means that if you've been using your brand for 20 years and can show that you've consistently used it in connection with specific goods or services, you might have some **legal rights** to the trademark under common law. This is true even if you never registered it.
Does anyone know if Amazon will accept this common and legal usage of common law trademark of my brand? I am not having good luck getting a response from Amazon.

Checking the Brand Registry eligibility guidelines, to enroll a brand in Brand Registry, your brand must have an active registered trademark or a pending trademark registration. That trademark must be a text-based mark (word mark) or an image-based mark with words, letters, or numbers (design mark) from approved government intellectual property (IP) offices.
Common law trademark rights do not apply for brand registry eligibility.
If there are any questions please let me know.
