Hello, I tried to register our brand with Amazon and received the error code 5665 and that the brand is already registered with Amazon. I have the trademark # for our brand. With that, can I sell my product under our trademarked name without registering the brand name in Amazon? I am trying to understand what we can do as the owners of this trademarked name. We cannot find the information on the Amazon seller who registered the brand name. Please help thank you

Back in the early days Amazon was not as knowledgeable about minor things like the LAW and the ownership of brand names.
There can be multiple brand names that are the same/similar but sell different products. Is the brand name currently in use on Amazon selling YOUR products?
Quite often a seller was able to register the brand name just by being a seller several years ago!
At this point you will probably need to send Amazon all the proof of ownership that you have at your disposal.
If the name on your seller account and the name and ownership of the brand name are not EXACTLY the same be prepare to prove common ownership.
I'm pasting my 'whitelist' information because it has all the info on the attorney chain for Amazon that you will likely have to fight through!
WHITELISTING
It seems clear that Amazon is only allowing MAJOR brands to 'whitelist' which sellers are authorized.
It was suggested by one of the long term experienced sellers on a different forum that the following has worked successfully in the past.
Have your attorney send a carefully worded Demand Letter (by Certified Mail) to Amazon’s "Office of the General Counsel".

I would think that you would want to include appropriate paperwork showing ownership of the TM from the USPTO, proof of registration in Brand Registry, and, any links to cases and messages that show that SO FAR Amazon has refused to protect your brand.
Basically, you need to put Amazon on notice that you expect the protections promised by Brand Registry.
