Brand Registry - Business License Required?

I want to pursue Brand Registry. Do I have to have a business license? I know I need to get the trademark done, but I keep reading about Amazon needing to verify the business somehow. What if I am just a sole owner? Is a business license a must for brand registry? Is an EIN also a must? What's the easiest way to get this done as a rookie and sole owner?

At the minimum, you need to have a retailer's sales license in your state. That established you as a business. Having a federal EIN number, allows you to collect and file federal withholding tax and social security payments for your employees.

Just make sure when applying your Amazon account, state retail license, and USTPO documents all match in name and address.

Being a sole member is the easiest. You do not need to pay any service to get the retailer's license, or any license for you. They can all be obtained and paid for online.

Remember, operating a successful online retail business is what you bring to the Amazon site. Amazon's goal as far as sellers are concerned, is to extract as much on your unearned profit as they can, hoping the seller doesn't recognizing what is going on.

As a final thought, If you set your goal as setting up and opening a retail store in your city, Amazon selling simply becomes a small part of the picture. If you set your goal as simply trying to get rich selling on Amazon, it is not going to happen.

Selling your brand on Amazon.

Remember, branded products are not just a one-off thing. You need a full line of products to sell.

Amazon only offers sellers a platform to sell their brand on. Amazon does not tell you how to create a brand, Amazon expects you have already created a brand to sell on the site. Does your brand really exist in the real world before coming to Amazon to sell it, or are you trying to start a brand by using the Amazon Site. That is the difference, and it is easy for Amazon to tell.

1. If your brand product really exists in the real world, your products will meet all US standards for packaging (child safety warnings, metal content, made in what country, warranty info, expirations, contact info, etc......as it pertains to the item sold), have all COC's necessary on file in your brand/company name, have GS1 registered UPC's in your business name on the product, even have MSDS's on hand in your company/brand name, just to start. Your own brand URL where customers can purchase your product line is always helpful but not necessary. In addition, it is always helpful to be able to show retailers around the country who carry your line of products. USTPO registered Trademark should not be pending, but the final determination document. When you were approved by your Liability Insurance Company, they asked for all of the same information prior to issuing the policy, so what Amazon asks for is no different.

2. Now if your brand does not exist, any one of these can cause a problem.

- Are you approved to sell in the category?

- Are you approved to sell the product?

- Your UPC does not match the GS1 data base.

- Don’t request a UPC exemption when you are a manufacturer?

- Your packaging does not meet US standards.

- Does your product have proper labeling and packaging in an easy to read format?

- The quality of your photo's need improving.

- Do you have all COC’s that may be necessary, issued from a USA based Lab.

- Do you have the PENDING or FINAL SECESSION from USTPO attesting that your Brand is now yours.

Generally, business license info or an EIN would not be required in the application, but may be requested down the line if any issues in verifying the business arise. Being a business is also not listed in the eligibility requirements to enroll in Brand Registry.
