Amazon selling a counterfeit item that we have a design patent on.
Amazon is selling a product that we have a design patent on. There are lots of knock offs in the market but this one is 100% our item. I filed a violation but the reply was:
Hello,
Thank you for your report of infringement. We reviewed your notices of infringement and determined that the notices you have submitted to Amazon are invalid or inaccurate. Reporting false, misleading, or consistently inaccurate notices of infringement violates our policies.
I probably won't take this any farther as its only 1 small product among our several thousand items and I don't want to push anything that may jeopardize our account but it doesn't make it ok. We do have a brand registry for many of our items but this one isn't in it. The product is B003Z5GW0O

I would think that a report of patent violation (as opposed to someone just selling your brand) should come from a Patent Attorney, not from you. That would get Amazon's attention.
But since that would cost you, only you can decide if it's worth the expense.

I will need some more info to dig a bit deeper into this, but I should be able to grab it from infringement report submitted already. Can you provide that complaint ID here and I will have a look?
More generally speaking, I'll first look for procedural type stuff like did you report patent infringement, but provide a description of how the product is counterfeit? These are 2 different types of infringement so that could be a reason the complaint wasn't accepted (for example). 2 more key components are: 1. Did you complete a test buy and provide the order ID info? 2. Did you provide the patent ID and describe specifically how the product you are reporting infringes on that patent.
If you do happen to have a patent attorney as @Seller_nRFmxiQg4EGrw (thanks for jumping in) mentioned, they could certainly help to write the complaint calling out the specifics where your patent is being infringed on.
