Unauthorized sellers in Canada causing product support issues.
I am a brand owner, I have my brand trademarked and registered with Amazon's Brand Registry. I do not sell on Amazon myself, but I have 2 authorized re-sellers with representative privileges. Both sellers are FBA My company does not ship to Canada.
We received a call from a Canadian customer who purchased our product on Amazon.ca from a 3rd party seller, who I believe has FBA send it to a 3rd party shipper. The unauthorized seller of course could provide no support, and as it was not FBA direct to customer Amazon won't deal with it. We have no record of the customer, or the sale.
I went on Amazon.ca and found up to 10 sellers on my ASIN, with different shipping origins. I have applied to register my Trademark, in Canada, and it is in my Brand Registry.
The reviews from Canada mention leaks, which we don't see in the US reviews, and I suspect at least one of being a counterfeit. (It's happened in the past, and one of the origins is from same place).
The prices are over double what I charge, probably reflects shipping. To order 10 test buys from each ASIN would be over$3000.00 It's a moot point however because when I log into Amazon.ca. every product shows as not available. I can only see the prices if I log out.
One my sellers in looking into doing FBA in Canada, and the pricing, and unauthorized sellers apt to be damaging our reputation.
My trademark is Natrichlor®, and my US listings show Visit the Natrichlor Store as the brand, but the Canada listings say Brand: Nchlor even with the same ASIN.
What do I need to do to remove the Canadian listings? I can't login to Canada Forum.

A Canadian trademark approved (not pending) and a test buy to see if it is counterfeit.
There is nothing illegal happening if the other sellers is selling your item under your trademark. Only if they are selling counterfeit items with your trademark.

That's because Amazon.ca does not ship to the USA.
They are purchasing your product and having it sent to a USA warehouse, which then forwards their stock to Canada. If there are only 2 places to purchase your products, your Canadian seller orders are either coming from Amazon.com or from your own website, and then being shipped to a US warehouse, then forwarded to Canada.
The only other thing that could be happening is one of your customers/distributors you sell to are reselling to Canada, which means you have to tighten up your supply chain.
You don't have an approved trademark in Canada. You can't legally enforce your trademark in Canada until you do.

Hello @Seller_SMiA5X0KCh61u
This is Sandy from the Community manager team here on forums. Thank you for the details here.
Amazon's policies allow any seller to list items for sale on an ASIN so long as the intellectual property accurately represents the item being sold and has not been illegally reproduced. This includes intellectual property for which you are the rights owner.
Without information on which ASIN is counterfeit, Amazon can't really take action since your CIPO trademark is still pending.
Falsely accusing other sellers of selling counterfeit products without valid proof could also backfire to your account as well.
My suggestion would be to wither complete a test buy (and return) or wait until your CIPO is registered and submit a Report a Violation request.
Please let me know if you have any questions.
