[Action required] Additional information required for EU establishment

Hello everyone,

I am sharing my experience with Amazon regarding a VAT and business location issue, hoping this can help other sellers or at least raise awareness about such situations.

I received an email from Amazon stating that I do not have an establishment in the European Union, which is completely false. My company is registered in France, I have a valid French VAT number, and Amazon has all the necessary proof of this.

The problem started with VAT management in the UK. According to Amazon’s policy, a UK VAT number is required only if:

You exceed £10,000 in annual turnover to the UK.

You store products there.

However, I meet none of these conditions. Yet, Amazon unilaterally decided to transfer part of my stock to the UK without my consent and without informing me. This forced me to obtain a UK VAT number to comply with regulations.

After analyzing the costs of managing this VAT number and my UK turnover, which is around £1,000 (practically insignificant), I decided to put my UK store in vacation mode, following Amazon’s recommendations.

Then, another surprise: Amazon asks me to pay the VAT due on these UK sales. I am entirely willing to pay this amount, which should be minimal given my low sales volume.

And today, a major blow! Amazon sends me an email threatening to suspend my account, claiming that I do not have an establishment in Europe… even though I am registered in France! Amazon insists that this information has been verified by humans, which seems either a blatant error or a sign of incompetence in handling these cases.

So, to summarize:

you state you have a registered business in France etc but when Amazon refer to established) they do tend to mean you have a physical base of operations where someone is making business decisions and you can take in things like stock or business supplies.

Now that may be the case, but it isn’t clear from your post if it’s the case.
