Request for Clarification on Selling Restrictions for Organic Food Item

Dear Amazon Selling Partner Support Team,

I hope this message finds you well.

We have been selling an organic food product from a certain brand for a couple of months through FBA. Prior to our procurement, we obtained a Letter of Authorization (LoA) directly from the brand, ensuring our compliance with Amazon's rules for wholesale.

However, four days ago, I received a notification stating that the product is now inactive, and I need additional authorization to relist it. When attempting to apply for activation, I encountered a message stating that applications for this product are no longer being accepted.

I reached out to Amazon Customer Support, and the issue was escalated. Today, I received the following response:

While I appreciate the response, I have a few concerns and questions:

1. Purpose of Authorization: What is the purpose of obtaining a Letter of Authorization if we are subsequently restricted from selling despite being compliant?

2. Sudden Restrictions: Why has this restriction been applied without prior notice? If this product was not eligible for sale, why was this not communicated earlier, before we incurred costs associated with procurement and FBA shipment?

We have operated in good faith, relying on our compliance with Amazon's requirements. Any additional clarification or guidance on resolving this matter would be greatly appreciated.

In general Seller Support isn't going to be able to reply to you here on the Forums due to the public nature of the Forums however I'm happy to review your most recent Case ID as a member of the Amazon Seller Forums Community Management team.

Regarding your questions, in general Amazon requests a number of different pieces of documentation to show the authenticity of a product. I suspect what is happening here is there are multiple restrictions impacting this product at the same time.

Amazon systems attempt to identify products that are restricted or require additional documentation before FBA units are shipped in, but given the scale of the Amazon catalog some ASINs are identified after the fact. Amazon still cannot permit the sale of products that are prohibited or can't be verified as compliant with all policies, including the Organic Products policy.

If you provide your Case ID I will review and see what options exist to appeal further. Thank you for your understanding.
